Islamabad: The Supreme Court (SC) on Monday declined a request submitted by the federal government to prohibit the Peshawar High Court (PHC) from taking up petitions against verdicts announced by the military courts, Dawn reported.
“Their judgement will help us,” said Justice Mushir Alam while hearing the plea submitted by Additional Attorney General Sajid Ilyas Bhatti on behalf of the federal government.
Justice Alam heads a three-judge bench which has, so far, heard over 70 appeals forwarded by the Ministry of Defence against a judgement announced by the PHC in November 2018; wherein the latter had ruled that the sentences handed over by the military courts on terrorism cases were “wrongful” and were based on “ill-will”.
Previously, the apex court had issued a stay on the PHC order; further directing the jail superintendent concerned to restrict the release of an accused who had received different sentences, including death, in a number of cases.
